All hold harmless agreements MUST have an Indemnification Clause, holding the Listing Agent and Listing Broker as well as Selling Agent and Selling Broker. A hold harmless is simly a "Feel good" wording which has not legal strength to protect. Review such clauses, insert them and keep ORIGINAL ink signed form in your fire safe for protracted liability protection. Remember to have your document read "All parties are to seek their own professional legal and accounting advice" for added protection.

Reviewed Short sale package and it looks pretty good however you may want to include property inspection report (FYI) as I have found in my years of experience this really help those agents that have to do BPO's on property and will asist in decision makeing on the Shortsale by Asset Managers and bank lenders.

Hi Bryant and Wendy,
Just purchased your short sale listing package and find it very neat and concise. I will incorporate it in my business. The only question I have is do I need for myself and my company a hold harmless agreement signed by the seller. I see a letter to seller with disclosures; Is that meant to cover our liability?

They will eventually cave. Counter them back with a new pre-hud and keep resubmitting. Contact the supervisors supervisor!! Thats how I managed to get 2 approved.
